Dirt work and excavation projects may be affected by buried debris, unstable soil, underground water, rock, old concrete, septic systems, drainage issues, roots, or hidden structures not visible before work begins.
The customer is responsible for disclosing any known underground systems, utilities, irrigation, septic, field lines, tanks, or other buried improvements prior to the start of work.
Utilities and Marking Responsibility
Customers are responsible for ensuring required utility locates are completed before excavation or ground disturbance begins. Stewart Dirt Worx is not responsible for damage to underground items that were not properly marked, located, or disclosed before work started.
If site conditions make utilities uncertain or unsafe, work may be delayed until proper locating or verification is completed.
Access to the Property
The property owner or customer is responsible for providing safe and reasonable access to the job site. Vehicles, trailers, materials, pets, fencing issues, locked gates, or other obstacles that delay work may impact scheduling and cost.
Stewart Dirt Worx is not responsible for delays caused by site access restrictions outside its control.
Ground Disturbance and Surface Damage
Heavy equipment, excavation, grading, demolition, clearing, and hauling can disturb existing grass, landscaping, drive edges, soft ground, and nearby surfaces. Some rutting, compaction, and surface disturbance may be unavoidable during normal operations.
Stewart Dirt Worx is not responsible for restoration of landscaping, sod, seeding, decorative features, or surrounding surfaces unless that work is specifically included in writing within the project scope.
Weather Delays
Weather conditions can directly affect scheduling, safety, equipment access, soil conditions, and final results. Stewart Dirt Worx may delay, reschedule, or pause work when weather conditions are unsafe or would negatively affect workmanship or site stability.
Rain, saturated soil, flooding, and other weather-related conditions may also increase labor, equipment time, or material needs.
Project Scope Changes
Any change in project scope, requested additions, site discoveries, material changes, or expanded work areas may require additional charges. Verbal discussions do not automatically revise the original project scope unless accepted by both parties.
Additional work may be billed separately or added through an updated quote or invoice.
Payment Terms
Payment terms will be listed on the applicable quote, invoice, or project agreement. Unless otherwise stated in writing, deposits may be required before scheduling, progress payments may be required on larger jobs, and final payment is due upon completion of the agreed work.
Late payments may be subject to collection efforts, attorney fees where permitted, interest or service charges where allowed, and suspension of future services.
Scheduling and Availability
Project dates are estimated based on current workload, weather, site readiness, and equipment availability. Estimated start dates and completion dates are not guarantees unless specifically stated in writing.
Stewart Dirt Worx is not liable for delays caused by weather, supplier issues, third parties, utility conflicts, hidden site conditions, or events outside reasonable control.
Limitation of Liability
